1. Nature of Services

GoChyro provides a technology platform that connects users (“Users” or “You”) with licensed chiropractors (“Providers”) who may provide chiropractic and related wellness services at a User’s chosen location. GoChyro is not a healthcare provider, does not practice medicine or chiropractic care, and does not control or supervise the Providers.

All chiropractic services are provided by independent, licensed professionals who are solely responsible for the care they deliver.

2. Eligibility

• • You must be at least 18 years of age to use the Platform.
• • By using GoChyro, you represent that you are legally capable of entering into binding agreements.

3. No Medical Advice

The Platform and any content available through it are provided for informational and scheduling purposes only. GoChyro does not provide medical advice, diagnosis, or treatment.

In case of a medical emergency, call 911 or your local emergency services immediately.

4. User Responsibilities

By using GoChyro, you agree to:

• • Provide accurate, complete, and updated information, including your health history.
• • Ensure that the location where the Provider visits is safe and appropriate for chiropractic services.
• • Follow any instructions or recommendations given by your Provider.

You understand and accept that failure to provide accurate information may result in adverse outcomes for which GoChyro is not liable.

5. Provider Responsibilities

Providers must:

• • Maintain an active chiropractic license in good standing.
• • Carry appropriate professional liability insurance.
• • Provide services consistent with professional standards of practice.

Providers are independent contractors, not employees, partners, or agents of GoChyro.

6. Payment & Cancellation

• • All payments are processed through the Platform.
• • You agree to pay the listed fees for services booked through GoChyro.
• • Cancellation and no-show policies apply; fees may be charged if you cancel within 1 hour of the scheduled appointment.
• • Refunds, if any, will be determined according to GoChyro’s refund policy in effect at the time of booking.

7. Insurance

GoChyro does not provide medical malpractice or professional liability insurance for Providers. Each Provider is solely responsible for maintaining adequate insurance coverage.

8. Limitation of Liability

To the maximum extent permitted by law:

• • GoChyro disclaims all liability for the acts, omissions, or negligence of Providers.
• • GoChyro is not responsible for any injuries, damages, or losses arising from chiropractic services provided through the Platform.
• • Your sole recourse for any dispute regarding services is with the Provider.

9. Indemnification

You agree to indemnify and hold harmless GoChyro, its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses arising out of or related to:

• • Your use of the Platform;
• • Services provided by a Provider; or
• • Your breach of these Terms.

10. Acceptable Use and Prohibited Conduct

You agree to use GoChyro only for lawful purposes and in accordance with these Terms. You may not:

• 1. Use the Platform to harass, harm, or exploit any individual, including Providers.
• 2. Engage in any illegal, fraudulent, or abusive activities.
• 3. Attempt to gain unauthorized access to the Platform, other users’ accounts, or data.
• 4. Use the Platform to solicit services outside of the official booking process.
• 5. Interfere with the proper functioning of the Platform or attempt to circumvent any security measures.

GoChyro reserves the right to suspend or terminate your account for violations of this clause and to report unlawful activity to law enforcement.

11. Data & Privacy

GoChyro collects and processes personal information in accordance with its Privacy Policy. If health-related information is collected, GoChyro will comply with applicable privacy laws, including HIPAA (if and where applicable).

12. Termination

GoChyro reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and without prior notice.

13. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising under these Terms shall be resolved through binding arbitration in Dallas. TX, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Modifications to Terms

GoChyro reserves the right to modify these Terms at any time. Changes will be effective when posted to the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.
